Phillips Brothers Auction Terms and
Conditions

 All bidders must be registered and approved online prior to bidding. Bidding on
any vehicle is confirmation of acceptance of all these Terms and Conditions.
 Bidders are welcome to inspect vehicles from the first day auction is posted
until the day prior of the auction closing by appointment only. When making an
appointment you must provide your vehicle interest list.
 The sale information is not guaranteed to be correct. Bidders rely solely on
their own observations, inspections, and evaluations in determining whether to
buy a vehicle. The buyer is responsible for all registration fees. License plate
tags are not guaranteed to be correct.
 All payments must be paid within 36 hours from the end of auction by cash or
to the link provided. All sales are final. No refunds and no returns. If vehicle is
not paid with in 36 hours the vehicle may be offered to the bid prior to yours.
 Paperwork for the vehicles will be sent out 1 business day after payment to the
address you provided and/or email is available as well.
 Any vehicles won must be picked up within 2 business days from payment. Any
vehicle not picked up by 2 business days will accrue $30 in storage charges per
day that it is here. On the 3 rd day of storage an admin fee of $75 will be added
and after 5 days a $25 certified letter will be billed and sent to you as a legal
notice of your responsibility of storage costs. If the vehicle sits for more than 2
weeks, the vehicle will be placed back into auction rotation.
 Phillips Brothers Auction is not responsible for loss or damage to vehicles that
are not immediately paid for and removed from the property.
 Phillips Brothers Auction hereby disclaims and excludes any and all warranties
of title, including without limitation that the title is good, and its transfer is
rightful, and that the vehicle is delivered free from any security interest or
other lien or encumbrance. Phillips Brothers Auction also disclaims and
excludes all warranties that the vehicle is delivered free from any rightful claim
of any third party by way of infringement or the like. All vehicles are sold “AS IS
WITH ALL FAULTS”. Phillips Brothers Auction hereby disclaims and excludes any
and all implied warranties, including without limitation the implied warranties
of merchantability and fitness for a particular purpose.
 All vehicles will be subject to a 10% buyer premium.
